Scope of application
N-Wines has set up an e-commerce service available on the Internet at the following address: www.n-wines.fr intended for consumer customers, i.e. any natural person acting for purposes which do not fall within the scope of his commercial, industrial, craft or liberal activity.
Acceptance of these general terms and conditions of sale
In the absence of specific stipulations agreed in writing between the parties, all orders placed on the Site are subject by right to these general terms and conditions of sale, which take precedence over any other document, such as prospectuses, press, catalogues or e-mailing issued by the Vendor, which have only an indicative value.
Any use of the Site and/or placing of an order implies having previously consulted and accepted the entirety of the present general conditions of sale.
N-Wines reserves the right to adapt or modify the present general terms and conditions of sale at any time. In case of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.
Offers / prices / orders
All our wine offers are valid while stocks last, excluding promotions, special offers and gifts. For the en primeur wines, please refer to the conditions indicated on the offer, while stocks last. The prices are expressed in Euros, including all taxes (with the exception of en primeur wines, indicated excluding VAT and transport, except as an indication). Considering the rare or speculative nature of certain products, we reserve the right to apply restrictions on available quantities, or even to refuse or cancel an order that is clearly abnormal.
Our offers are exclusively reserved for consumer customers, and under no circumstances for professional resellers. Orders are confirmed by the sending of the invoice, but are only final upon receipt of full payment of the price of the goods.
Terms and conditions of payment
The payment of the goods is made in full at the time of order, either by credit card type Carte Bleue, Visa, Eurocard Mastercard, American Express, or by transfer to our bank account with the following references:

No extension can be granted without our express prior consent.
An invoice expressed in Euros including all taxes will be issued by N-Wines and sent to the customer at the indicated billing address. For any order over 750 Euros including all taxes delivered at one time to an address located in metropolitan France, the delivery is made free of charge. For any order less than 750 Euros including all taxes, a contribution of 25 Euros including all taxes will be requested to cover transport costs, and for multiple deliveries in metropolitan France, a contribution of 16 Euros including all taxes per recipient will be added.

All our products are shipped with the utmost care from our warehouse and those of our dealers . A particular care is taken during the preparation of your parcels to guarantee an optimal delivery. All our parcels have a guarantee band to preserve the integrity of your package.
Deliveries are made in Metropolitan France.
N-WINES offers several delivery options:
– For Metropolitan France :
From 9,90€ TTC for a standard delivery within a maximum period of eight working days, directly to your home or workplace. For a home delivery, it is imperative that one person is present (at the address indicated when ordering) on the day of delivery.
From 15€ TTC for a delivery on demand with choice of a time slot from Monday to Saturday morning. You can choose a time slot of 4 hours (morning or afternoon) according to your preference. An email will be sent to you by the carrier to fix your time slot as soon as your order is dispatched.
From 18€ TTC for an express delivery in 48H.
Shipping is free for any order of 200 € or more including all taxes for metropolitan France.
– For Corsica :
25€ TTC for a standard delivery within a maximum of ten working days.
Deliveries tracked by our services
All orders shipped are subject to a rigorous follow-up by our services. In the event of any hitch, you are immediately notified by e-mail or telephone and you are free to modify or cancel your order. The contents of each parcel are systematically checked before being sent, to ensure total conformity with your order. The order is delivered to the delivery address chosen by the customer, during the validation of his order and according to the shipping method chosen.
All our wines are delivered in neutral packaging suitable for transport. In the event of high heat or extreme cold, we may have to postpone shipments in order to preserve the quality of our wines. In this case, we will inform you of the delay in your delivery.
In the event of a problem on delivery
Deliveries are made Monday to Friday from 9am to 6pm and Saturday morning from 8am to 12pm (in the case of the on-demand or express delivery option). In the event of absence at the address indicated by the customer, a delivery notice is normally left in the mailbox. The customer can then make an appointment for a new delivery.
Upon receipt of your order, if the appearance of the packaging does not appear to be in conformity, you must notify this on the delivery slip. In the obvious case of broken bottles, you must refuse the carton concerned and ask for it to be returned to the sender.
In the latter case, you must contact our customer service, by e-mail or telephone within a maximum of 3 working days so that we can proceed with a new shipment or refund.
Return – Returns
All products sold on the site benefit from a “satisfied or reimbursed” clause valid for 15 days from the date of delivery. You can also exercise your right of withdrawal within 15 days of receipt of your products. To formulate your right of withdrawal, use the contact form available. The return costs shall be borne by the customer and the price paid for the returned goods shall be refunded to the customer by credit card or cheque within one week of receipt of the return.
Any sum not paid on the due date will automatically and by right, without prior formal notice, give rise to a penalty at the legal interest rate in force. In the event of recovery by way of litigation, a proportional indemnity corresponding to the costs incurred in respect of the said lump-sum recovery, which N-Wines estimates at 15% of the amount of the order, will be paid.
Right of withdrawal
You have the right to withdraw from this contract without giving reasons within fourteen days. The withdrawal period shall expire fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically take possession of the goods. The Customer may also, at his express written request, exercise his right of withdrawal from the conclusion of the contract. In the case of a contract relating to several goods ordered by means of a single order and if these goods are delivered separately, the period shall expire fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good.
In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, letter sent by post, fax or e-mail) to the following address

You can also use the model withdrawal form below but it is not mandatory.
For the withdrawal period to be respected, it is sufficient that you send your communication on the exercise of the right of withdrawal before the expiry of the withdrawal period.
By exception, these provisions will not apply to orders for products that are customised or specifically requested by the Customer when ordering (special formats, customised packaging, etc.).
Effects of withdrawal: If you withdraw from this contract, we shall refund all payments received from you, including delivery charges (except for any additional charges arising from the fact that you have chosen, where applicable, a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will make the refund using the same means of payment that you used for the original transaction, unless you expressly agree to a different means; in any event, the method of refund chosen will not incur any costs to you. We may defer a refund until we have received the goods or until you have provided proof of shipment of the goods, whichever comes first.
You must return or surrender the goods to the address that will appear on the heading of your N-Wines invoice without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract. This time limit is deemed to be respected if you return the goods before the fourteen day period expires.
You will have to pay for the direct costs of returning the good (a flat rate of 17 euros excluding VAT plus an average of 2.37 euros excluding VAT per bottle for mainland France).
By virtue of the exception provided for in point 7 of article L.121-21-8 of the Consumer Code, (Supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed upon at the conclusion of the contract depends on market fluctuations beyond the control of the professional) the right of withdrawal is excluded from contracts for the sale of en primeur wines.
The Customer shall only be liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.
Exchange of a product
In case of stock shortage of the ordered products, N-Wines can propose to the customer to replace them, with his agreement, either by another vintage, or by an equivalent wine.
Retention of title clause
By express agreement, all our goods remain our property wherever they are until full payment of the invoices due. This does not prevent the transfer of the risk of the goods to the Customer upon delivery of the goods.
We draw your attention to the fact that:
– the Customer has a period of 2 years as from the delivery of the good to act;
– in the event of a lack of conformity, N-Wines will replace, in accordance with article L.211-9 of the French Consumer Code, the product by the same product or an equivalent product. The replacement will be carried out within a maximum period of 1 month from receipt of the product returned by the Customer, and after tasting by our sales teams trained and qualified in oenology confirming the alleged defect in a contradictory manner;
– Since 18 March 2016, the Customer is exempt from having to provide proof of the existence of the defect in the goods during the 24 months following delivery of the goods;
– the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted to the Customer;
– in the event of defects or latent defects in the product, the Customer may decide to implement the guarantee of article 1641 of the Civil Code and in this case, he may choose between cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.
Cancellation of the contract
In the event of non-payment by the Customer or withdrawal of the goods on the agreed due date and one month after a notice of default that has remained unsuccessful, the sale shall be automatically cancelled at the Seller’s discretion, with the return of any advance payments made by the Customer and the possibility for the Seller to request, in summary proceedings, the return of any products already delivered, without prejudice to any other damages.
Amicable settlement of disputes
In the event of difficulties in the application of these general terms of sale, we invite you to seek an amicable solution by contacting our Customer Service beforehand. In accordance with the provisions of articles L 611-1 and R 612-1 and following of the Consumer Code concerning the amicable settlement of disputes, if you have sent a written complaint to the professional and you have not received satisfaction or a response within two months, you may submit your complaint free of charge to the consumer ombudsman. The Ombudsman must be contacted within a maximum of one year from the initial complaint. The mediator is MEDIATION-NET. Applicable law and jurisdiction
The present general conditions of sale are subject to French law. In the event that any of the clauses of the present general conditions of sale are null and void, this shall in no way affect the validity and compliance with these general conditions of sale. In the event of a dispute that may arise following or on the occasion of the placing or execution of an order, the competent French court will be designated in accordance with the rules of common law.
Protection of minors
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited. The Customer declares and undertakes to be at least 18 years of age on the date of the order.
Alcohol abuse is dangerous for your health, consume in moderation.
The photos appearing on the site are provided for illustrative purposes and without contractual value. We invite you to refer to the description of each product to know its precise characteristics.
In accordance with the provisions of Law n°98-536 of 1 July 1998, transposing Directive 96/9/CE of 11 March 1996, concerning the legal protection of databases, N-Wines is the producer and owner of all or part of the databases making up this Site.
